| Locality | Pursuant to the Illinois Freedom of Information Act, 5 ILCS 140, I request records concerning the water/sewer utility account associated with: 1215 W. Sherwin Ave., Chicago, Illinois This request concerns an approximately $3,500 water charge attributed to unusually high consumption during approximately January and February 2025 that has been disputed by the account holder. Please provide, for the period January 1, 2025 through the present: 1. A complete account ledger showing all charges, payments, credits, adjustments, transfers, reversals, penalties, interest, and other account activity. 2. Records showing how each payment received from the account holder was allocated, including the charge, billing period, balance, or other obligation against which each payment was applied. 3.	Records reflecting any application of payments made after the disputed approximately $3,500 charge toward that disputed balance. 4. Records reflecting any adjustment, transfer, reallocation, correction, or manual modification of payments or balances associated with the account. 5. Account notes, customer-service notes, call logs, case notes, dispute records, supervisor notes, or other records concerning the account holder's dispute of the unusually high January–February 2025 water charges. 6. Records concerning the referral or placement of the disputed balance with a collection agency or other third-party debt collector, including the amount referred, date of referral, subsequent balance information transmitted to the collector, and records of any settlement authorization or settlement amount communicated to the collector. 7. Records reflecting any offer or authorization to resolve the disputed balance for approximately 50% of the amount claimed due, including records sufficient to identify how that settlement amount was calculated. 8. Records reflecting the Department's determination that the unusually high January–February 2025 consumption and resulting charges were valid, including any information received from or exchanged with the Department of Water Management concerning the meter readings underlying those charges. Please provide responsive records electronically. Where account or payment information is maintained as structured electronic data, I request it in its native electronic format (CSV, spreadsheet, database export, or similar format) where reasonably practicable. If records responsive to any portion of this request are maintained by another City department, please identify that department. If any responsive record contains exempt and non-exempt information, please redact only the exempt material and produce the remainder. If any records are withheld, please identify the applicable statutory exemption. Please be advised: The disputed charges are presently the subject of an administrative enforcement action initiated by the City of Chicago Department of Finance against the 1215 Sherwin Condo Association before the Department of Administrative Hearings, Municipal Hearings Division, Docket No. 26WD02121M / ANOV No. HBM000024, with a hearing scheduled for August 15, 2026 at 9:00 a.m. In that proceeding, the City alleges that $1,614.13 in utility charges remains unpaid after application of credits, adjustments, and deductions, and seeks an additional $350.00 in attorney's fees and $25.00 in administrative costs, for a total requested judgment of $1,989.13. The Association disputes the underlying utility debt because it derives, at least in substantial part, from the anomalous water consumption that is the subject of this request for investigation. Given the pending proceeding, the Association requests immediate attention to this matter and preservation of all potentially relevant physical and electronic evidence concerning the meter, MIU, meter-reading and transmission data, billing calculations, and account history. |
