| Locality | Dear FOIA Officers: This is an Illinois Freedom of Information Act request for Tax Increment Financing (TIF) documents that the city is required to provide to the Cook County Treasurer’s Office (CCTO) under Cook County’s Debt Disclosure Ordinance (Section 2-243 of the Cook County Code), as amended by the County Board in February 2021. This request is being sent to both the Chicago Department of Planning and Development and the Department of Procurement Services, as we have been informed that those two departments possess the data the city is required to submit to CCTO. Although the City of Chicago in late 2021 did provide some of the data required under DDO, it fell well short of complying with all the DDO requirements. Specifically, the City filed what it described as the data submitted to the Illinois Comptroller pursuant to 65 ILCS 5/11-74.4-5(d) for each year a TIF district was active in Chicago during the previous five years. As you can see from the attached spreadsheet, labeled “Missing Chicago TIF Files,” Chicago filed for 2017 through 2020, but omitted all the required data for 2016 while not filing for every other required year for numerous TIF Districts. Accordingly, I request that the City to provide all of the relevant data required for 2016 through 2020 under Cook County Code Section 2-243 (C)(1). The city also filed no data or documents whatsoever to comply with 2-243 (C)(2 – 6). Accordingly, I also request that the City the submit the data required under 2-243 (C)(2 – 6). Those requirements are as follows: (c) (2): requires that when reporting TIF District Redevelopment Project Costs, the reporting taxing district must include the name of the vendor, contractor or Taxing District to which each payment was made and the dollar amount paid; (c) (3): requires that all administrative, management and staff costs be listed with the employee paid, the employee’s job title and the amount the employee was paid; (c) (4): requires that contracts entered by each TIF district be submitted electronically; (c) (5): requires submission of all Economic Disclosure Statements (EDS) submitted by each TIF vendor and/or contractor; (c) (6): requires reporting of all transfers, with dollar amounts, from one TIF District to another, along with the reason for each transfer. Meanwhile, we are establishing an improved in-house DDO reporting system that we hope will make the process of complying with the ordinance clearer and more streamlined. I have attached the Excel spreadsheet that will be deployed once that system is up and running in the next few weeks to give you a better idea of how the process will work moving forward. You also may use the spreadsheet to comply with this FOIA, if you wish. We also anticipate that the improved system will have a separate way for the City to submit the required contracts and EDS documents. For now, I’ve attached a Word document that explains which documents are required to be submitted to us. Should you have questions about this request, please do not hesitate to contact me via any of the contact methods listed in my signature line. Thank you for your attention to this matter. 2-243(c)(4) Please upload any and all contracts between the municipality/TIF district and any party that has received or will receive tax increment revenues. This includes all vendors, contractors, consultants, other governments/agencies, or other such relevant parties. 2-243(c)(5) Please upload any and all Economic Disclosure Statements from vendors, contractors, consultants, other governments/agencies, or other such relevant parties as disclosed pursuant to Section 2-243(c)(2)(b). |
