| Locality | Pursuant to the Illinois Freedom of Information Act, 5 ILCS 140, I request the records described below. This submission contains three separate requests, lettered A, B-1, and B-2. I ask that each be produced as it becomes available rather than held pending completion of the others. Request A consists substantially of records the Department has already compiled and released to other requesters. Requests B-1 and B-2 are variations on a query the Department has already run in response to F135716-041026. This request is not made for a commercial purpose within the meaning of 5 ILCS 140/3.1. It is made in connection with proposed municipal legislation concerning last-mile delivery operations and safety in the public right-of-way. Machine-readable format (CSV or Excel) is requested for all items. REQUEST A — Smart Streets Pilot Program A-1. Copies of the records produced by the Department in response to FOIA request F139197-051226 (received May 12, 2026) and FOIA request F141813-060426 (received June 4, 2026), in the same electronic format as previously produced. I understand these two productions together to cover Smart Streets violation data from November 1, 2024, through approximately May 7, 2026. These records have already been compiled and reviewed, and this subpart asks the Department to create no new document. A-2. The same records, with the same fields and in the same format, for the period May 1, 2026, through the date this subpart is processed. Any overlap with A-1 will be reconciled on my end; please do not withhold or trim on that account. A-3. Records of all warning notices issued under Sections 9-108-040(b)(1) and 9-108-040(b)(2) of the Municipal Code from November 1, 2024, through the date this subpart is processed, with the same fields as A-1. I understand the A-1 productions to comprise citations only. For A-1 through A-3, to the extent maintained, please include: date and time of the event; date of notice; location, including street address and geographic coordinates, as available; violation code and description; indicator of whether a warning or a citation was issued; fine amount and payment or disposition status; plate type; license plate number (see below); registered owner name and address; the camera or City vehicle identifier associated with the event; and ward. REQUEST B-1 — Supplement to F135716-041026, additional violation codes. This request supplements the production in F135716-041026 and does not ask the Department to reproduce anything already provided. Same criteria as that request: (1) plate type is not PAS; (2) plate type is not TXI; (3) date range January 1, 2017, through January 31, 2026. The only change is the violation code list. Violation codes requested: 9-64-020(a); 9-64-040; 9-64-040(a); 9-64-040(b); 9-64-080(a); 9-64-080(b); 9-64-100(a); 9-64-100(d); 9-64-100(e); 9-64-100(h); 9-64-110(e); 9-64-110(g); 9-64-110(h); 9-64-140; 9-64-140(a); 9-64-140(b); 9-64-150(a); 9-64-150(b); 9-64-160; 9-64-160(a); 9-64-160(b); 9-64-160(c); 9-64-170(a); 9-64-170(b); 9-64-170(c); 9-64-170(d); 9-64-180; 9-64-180(a); 9-64-190(a); 9-64-190(b); 9-64-190(c); 9-76-190; 9-80-095. Please include the same fields produced in F135716-041026: Ticket Number; Notice Number; Owner Last Name; Owner Second Name; Owner Address; Owner City; Owner State; Plate Type; Violation Code; Violation Description; Issue Date and Time; and the At: fields (Street No., Dir., Street Name). Please also include the license plate number, as discussed below. REQUEST B-2 — Continuation of F135716-041026. Same criteria as F135716-041026, for the period February 1, 2026, through the date this subpart is processed, and covering both the violation codes originally requested in F135716-041026 and the additional codes listed in B-1 above. Same field list as B-1. LICENSE PLATE NUMBERS For each of the requests above, I ask that the license plate number be produced for those records in which the registered owner is a business entity rather than a natural person. This category is identifiable based on the absence of a last name and requires no case-by-case judgment by the Department. Records so identified do not qualify as "personal license plates" as that phrase is intended and used at 5 ILCS 140/2(c-5). The qualifier "personal" before "license plates" cannot be read as mere surplusage. Had the legislature intended an exemption for all license plates, it would not have included the word "personal." If "personal license plates" is coextensive with "all license plates," then "personal" does no work. Where the registrant is a corporation, limited liability company, partnership, or trust, there is no "possibility of attribution to any person" within the meaning of Section 2(c-5). "Person" in that sense means a natural person, as distinguished from corporate and like entities. The default definition in the Illinois Compiled Statutes reflects this at 5 ILCS 70/1.05: "'Person' or 'persons' as well as all words referring to or importing persons, may extend and be applied to bodies politic and corporate as well as individuals." The distinction between individuals and bodies corporate is drawn consistently throughout the Illinois statutes. Production of the plate numbers requested here will not produce the personal license plate of any individual, but only those of corporate or comparable entities. The Department has produced business registrant names and addresses in F135716-041026, and produced business registrant information in the Smart Streets productions referenced in Request A, so this request asks for an additional field on records the Department has already determined to be disclosable in relevant part. If the Department declines to produce plate numbers for any category of record, I ask that it produce those records without the plate field rather than withhold or delay the production, and that it identify the category and the exemption claimed. Clarification on Previous Request Request F135716-041026 included violation codes 9-101-020 and 9-102-020. The production returned no records under either code, while returning approximately 534,000 records under 9-100-045(b)(1) and 9-100-045(b)(2). If citations under 9-101-020 and 9-102-020 are maintained in a separate system or under different code designations, I would appreciate knowing that so I can direct a request appropriately. This is a question rather than a request for records and should not delay any of the above. Please direct any questions to me at this address. If any portion of this request is denied, please cite the specific exemption relied upon and produce all reasonably segregable non-exempt material. |
